Many legal and ethical obligations exist in relation to the collection, holding and/or disclosing of personal information. These are governed by The Privacy Act and The Information Privacy Principles (IPPs).

Privacy

Most businesses collect, hold and/or disclose personal information about individuals during the course of business. Personal information can simply be the name and address of a customer.

The Privacy Act 1988 (Cth) sets out a number of rules that certain businesses must comply with when collecting, holding and disclosing personal information. Even if your business is not a particular business covered by the Act, most people believe that it makes good business sense to demonstrate to customers that you have chosen to comply with the rules.

The rules require businesses to at least have a privacy policy. Customer consent forms may also be required. Some businesses may have to implement new systems and procedures to ensure the security of personal information stored by them and some may need to appoint privacy officers to deal with customer complaints and requests to access information.
